Refused or Got an RFE? What to Do Next

A UK Global Talent refusal and a US O-1 RFE are different mechanisms with different rules — here's the shape of each, and where people go wrong first. This is preparation guidance, not legal advice.

If your UK Global Talent endorsement was refused

You have 28 calendar days to request a review — and you only get one. The review does not re-weigh your evidence or accept anything new. It only checks whether the endorsing body followed the correct process — for example, whether a piece of evidence you submitted wasn't properly considered. Arguing that your evidence was "actually good enough" is the single most common way people lose their one review request. If the review confirms the original decision for the same reasons, your only path forward is a new application — with the £561 endorsement fee again.

If you received a US O-1 RFE

This is the opposite situation. An RFE is not a denial — it's a request for more evidence before USCIS decides, and unlike the UK review, you can and should submit new or strengthened evidence. The commonly cited response window is 84 days from the notice date (87 with mailed service), though some notices carry shorter deadlines — always check your own notice. Build your response item by item against exactly what USCIS flagged, not a general restatement of your case.
